Welcome to EffortlessVI! We provide tools designed to make everyday life easier and more accessible for the blind and visually impaired.
By using our website, software, or tools (collectively, the "Services"), you agree to these terms.

1. Who We Are and Governing Law

EffortlessVI is operated as a registered Sole Proprietorship in the State of Tennessee, USA. Any legal disputes, claims, or issues relating to these terms or our Services will be handled exclusively under the jurisdiction and laws of the State of Tennessee and the United States.

2. Accounts and Communication

• Phone Verification: To keep account access secure and straightforward, we do not utilize traditional passwords. You log in to your account using your phone number via a one-time verification code sent by our partner, Twilio.
• Responsibility: You are solely responsible for maintaining control over your account credentials, and for all activities that occur under your phone number.

3. Modifications to the Terms

We may update these Terms from time to time to reflect changes in our software or regulatory requirements.

• Immediate Binding by Consent: If we update the Terms and you explicitly click to accept them, the new Terms bind you immediately.
• Delayed Binding by Billing Cycle: If you do not explicitly accept the updated Terms, they will automatically apply to you at the start of your next billing period if you continue using the Services.
• Right to Leave: If you do not agree to the modified Terms, your sole recourse is to stop using the Services before the next billing period begins.

4. Price Changes and Subscription Expirations

We believe in complete pricing transparency. We will never raise your price or alter your plan's cost without your explicit, manual permission.

• No Automatic Price Hikes: If we change the pricing of a plan you are currently actively subscribed to, that change will not apply to you automatically.
• Mandatory Re-acceptance: To implement a price change for your account, we will request your explicit confirmation. If you choose not to accept the new price tier, your current subscription plan will be set to expire automatically at the very end of your current paid billing period.
• Lapse of Access: Once the plan expires due to non-acceptance of a price update, your account tools will freeze until you manually log in and re-subscribe at the current market rate.

5. Account Credits, Upgrades, and Cancellations

To ensure you never face unexpected or hidden charges, we operate a completely transparent, user-controlled billing model:

• Trial Credits: New user accounts begin with free trial credits to test the capabilities of the Services.
• Completely Manual Upgrades: We do not automatically enroll you in recurring subscription plans or charge your payment method without your explicit action. All upgrades must be initiated by you, manually.
• Account Restrictions: If your account runs out of trial or paid credits, the software will block access to the tools entirely until you choose to purchase additional credits.
• Credit Expiration: Paid credits do not continuously roll over. Any unused credits expire at the end of the billing period they were purchased for.
• Changes: If you upgrade your plan mid-cycle, you will pay the full price for the new plan tier. Your billing cycle will start fresh on the day you perform the upgrade. You will have access to any previously unused usage in addition to your new plan.
• Cancellations and Downgrades: If you downgrade or cancel your service, your active credits remain available for you to use until the end of your current plan period.

6. Refund Policy

Because we provide upfront trial credits for you to thoroughly test our software before purchasing, all sales are final.
We do not issue cash, credit card, or bank refunds for downgrades, cancellations, or unused credits under any circumstances.

7. Content, Image Uploads, and NSFW Data

Our Services include tools that process pictures you upload or take through your device camera:

• Ownership: You retain complete ownership of any images, text, or data you upload to the Services.
• Sensitive Content (NSFW): If you upload Not-Safe-For-Work (NSFW) or adult images, our system tools are designed to provide a literal, objective, safe-for-work text description of the scene context without filtering out critical environmental details.
• Security & Privacy of Uploads: Your images and their generated text descriptions are strictly locked to your unique User ID and an image hash. No other users can access your uploaded content.

8. Disclaimer of Warranties

Our Services are provided on an "as-is" and "as-available" basis, without any warranties of any kind, either express or implied.
EffortlessVI does not guarantee that the services, software, data outputs, or automated descriptions will be accurate, uninterrupted, or error-free.
The tools are intended for informational purposes and to assist you, but they are not a substitute for primary mobility aids, professional guidance, or your own independent judgment.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall EffortlessVI, its owner, or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages whatsoever. This includes, but is not limited to, damages for personal injury, property damage, loss of data, loss of business, or any financial losses arising out of or in connection with your use or inability to use the services, even if EffortlessVI has been advised of the possibility of such damages.

10. Product Terms and Severability

• Product-Specific Terms: Product-specific terms and operational rules are incorporated into these Terms by reference. Your currently active product terms are always available from within each specific product's main interface. In the event that any specific term found within a product's terms conflicts with these global Terms of Service, these global Terms shall prevail.
• Severability: If any provision or part of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that specific provision will be limited or eliminated to the minimum extent necessary. The remaining portions of these Terms will continue in full force and effect.
